Terms and Conditions of “TrueMove calls at 50 Satang per minute and other number calls at 1.50 Baht per minute” promotion

1.  This promotion is applicable to those who sign up for TrueMove Pre Pay service having the account activated with Chaiyo SIM during the period from 5 October 2010 to 31 January 2011 or until further notice.

2.  The followings are call rates for this promotion:
     2.1. Calls made to TrueMove numbers are charged at 50 Satang per minute (excluding 7% value added tax and rate after VAT is 53 Satang per minute) throughout 24 hours based on per minute billing and a fraction of each minute is counted as one minute;
     2.2. Calls made to other mobile networks are charged at 1.50 Baht per minute (excluding 7% value added tax and rate after VAT is 1.60 Baht per minute) throughout 24 hours based on per minute billing and a fraction of each minute is counted as one minute.

3.  Such fees are applied for calls made to mobile or fixed line number used or registered locally as well as any other specified extra services only, which exclude calls made to any special number, international call, international roaming, short message service or other value added services.

4. The users will receive a validity period of 365 days every 10 to 1,000 Baht top up and the said validity period can be accumulated up to 365 days.

5.The users are eligible to receive validity period pursuant to Clause 4 on the condition that the users agree to make a call (only to any non-toll free number) or top up at least every 90 day. If neither action has been done during the said period, the users agree to have their account temporarily suspended for a period of 18 days and then terminated on the following day.

6. During such temporarily suspension period, the users may make a top-up to stay valid subject to conditions in Clause 4.

7. TrueMove top-up under Clause 4. excludes transferring remaining calling credits through True Transfer or Mobile Top Up or top up via True Money.

8. New applicants who sign up between 5 October 2010 to 31 January 2011 will receive a free call bonus as follows:
     8.1. Those who apply for this service with a 99-Baht SIM card are eligible to receive a calling credit of 10 Baht and free calling credit bonus of 25 Baht, totaling of 35 Baht, immediately upon activation;
     8.2. Those who apply for service with a 49-Baht Took Jai SIM are eligible to receive a calling credit of 5 Baht and free calling credit bonus of 10 Baht, totaling 15 Baht, immediately upon activation.

9. Conditions for use of free call bonus:
     9.1.  A minimum of five Baht calling credit is required.
     9.2.  Upon the remaining of free call bonus, a call charge would be respectively deducted from such free calling credit value and the topped up value as per the rate associated with the User’s selected promotion.
     9.3. Service under Clause 2 as well as the free call bonus shall be valid as long as the User’s phone number does not fall into a temporary or permanent suspension period.
     9.4.  Such free call bonus applies to any call made to mobile or fixed line number used or registered in Thailand only, excluding those made to any special number, international calls, international roaming, SMS and other value-added services. It can be neither transferable nor redeemable for cash nor any other promotions.

10. This promotion cannot be used in conjunction with hi-speed Internet Super package.

11.  By joining TrueLife Free View and All Together Bonus the users are required to comply with Terms and Conditions of such programs.

12. This promotion is valid until 1 April 2011.
13.This promotion cannot be used in conjunction with True Transfer and Mobile Top Up programs.

14. Those who use this promotion can switch to other promotion by calling 9305 and a service charge is applied subject to terms and conditions of each promotion.

15. In case of switching to any other promotion, the remaining validity days under this promotion may be transferred for use until expiration or up to 30 days. Accordingly, such validity days will be updated on the following day or within 48 hours after switching promotion.

16. “Objectives of the contract”: The User agrees to use the service under this promotion for normal, personal and individual use with honest interest, not for otherwise. The User shall not use, exploit, modify or commit any act on technology or system or any other devices so as to connect or relate to such service and shall not commit or omit any act that can be described or anticipated or believed that it shall cause an immoral act or a damage or an unfair treatment to TrueMove or any other person directly or indirectly or disturbance or inconvenience or hazard to network or make the network or its part malfunction in any way.

If the User commits any act according to the aforesaid paragraph, it shall be deemed that the User offends the objectives of the contract. TrueMove reserves the rights to immediately terminate its service under this contract if there is a reasonable ground to believe that the User uses the services by any of the following ways:
     16.1 Use the services against the contract or the prohibition of the contract or offend the objectives of the contract or has a dishonest intention towards the service or commit any act that causes or can be anticipated or believed that it shall cause damage to TrueMove in any way; or
     16.2 Use the service by way of defraud; or
     16.3 Use the service illegally.

17. TrueMove reserves the rights to suspend, change or cancel this Terms and Conditions there is any illegal act or failure to comply with specified Terms and Conditions or if TrueMove wishes to amend or change this Terms and Conditions without prior notice.

18. TrueMove reserves the rights to amend, change, suspend or cancel its service without prior notice if there is any regulation, order or policy stipulated by any relevant public authority, causing TrueMove to amend, change, suspend, or cancel Term and Condition of this promotion, or such order increases burden to TrueMove operation.

19. This promotion is subject to Terms and Conditions set forth by TrueMove. The users are required to find out more information prior to using the service on www.truemove.com or True Move Care on 1331 or by enquiring a TrueMove sales representative. TrueMove reserves the rights to discontinue its service, alter any type of service, amend Terms and Conditions or call rate as it deems appropriate with notice subject to change.

20. Existing users cannot switch to this promotion.
