Terms and Conditions of “Super Buffet: Unlimited calls all day all night 20 hours 199 Baht plus free Color Ring downloads” promotion

1. This “Super Buffet: Unlimited calls all day all night 20 hours 199 Baht plus free Color Ring downloads” (Super Buffet) promotion is available for individual TrueMove Pre Pay users from 1 September to 7 October 2010 or until further notice.

2. The users are required to call 9331 to apply for the “Super Buffet” promotion and pay signup fee of 199 Baht. However, a minimum of one valid day must remain in the users’ account prior to signup for this service.

3. The users are eligible for unlimited calls within TrueMove network during the buffet period of 30 days as from the date of signup for service with no valid day offered.

4. The users are entitled for “free monthly Color Ring fee and free downloads of 3 songs per month” throughout the entire period of this promotion if signup via 2222 (5 Baht per minute).

5. Call fee during the 30-day buffet period are divided into two sub-periods as follows:

     5.1 Calls made to TrueMove numbers during the period from 10:00 p.m. – 5:59 p.m. of the following day are covered by package fee of 199 Baht and calls made to other networks are charged additionally at 1.25 Baht per minute based on per minute billing;

     5.2 Calls made to TrueMove networks during the period from 6:00 p.m. – 9:59 p.m. are charged at 50 Satang (0.50 Baht) per minute and calls made to other networks are charged additionally to the package fee at 1.25 Baht per minute based on per minute billing;

     5.3 Sending SMS to any network is charged at 3 Baht per message (excluding value added tax and charge after VAT is 3.21 Baht per SMS) throughout 24 hours. This rate is valid to text messages sent to mobile phones used or registered in Thailand only which exclude special message service;

     5.4 Sending multimedia messages (MMS) is charged at 5 Baht per message (excluding VAT and charge after VAT is 5.35 Baht per MMS);

     5.5 EDGE/GPRS fee is charged additionally to the package fee at 1 Baht per minute (excluding VAT and price after VAT is 1.07 Baht per minute.) based on per minute billing and a fraction of each minute is counted as one minute, effective until end of promotion.

6. Call rate after end of the 30-day buffet period is charged at 50 Satang per minute for calls made within TrueMove network and 1.25 Baht per minute for calls made to any other networks afterwards based on per minute billing.

7. This promotion cannot be used in conjunction with All Together Bonus.

8. Such call rates are applied for calls made to mobile or fixed line number used or registered in Thailand only, excluding calls made to any special number, international call, international roaming, special short message service or other value added services.

9. The users are entitled to make unlimited calls within TrueMove network during the buffet period as long as the validity period for TrueMove Pre Pay remains. Upon end of such period, the users are not eligible for the said service until next top up.

10. The users can check the remaining period for the unlimited calls within TrueMove network during the buffet period promotion on 9331 (toll free).

11. The users will immediately receive a validity period of 365 days every 10 to 1,000 Baht topup and the said validity period can be accumulated up to 365 days.

12. The users are eligible to receive a validity period as per Clause 11 on the condition that the users agree to make a call (only to any non-toll free number) or top up at least every 90 day. If neither action has been done during the said period, the users agree to have their account temporarily suspended for a period of 18 days and then terminated on the following day.

13. During the temporarily suspension period, the users may make a top-up to stay valid subject to conditions as per Clause 11.

14. Topup under Clause 11 excludes transferring remaining calling credits through True Transfer or Mobile Top Up or top up via True Money.

15. Upon switching to this promotion, the remaining privilege and free call bonus for other promotion will be then terminated.

16. Conditions for use of free call bonus (if any):

     16.1 A minimum of five Baht calling credit is required;

     16.2 Upon which the free call bonus remains, a call charge would be respectively deducted from such free calling credit value and the topped up value as per the rate associated with the user’s selected promotion;

     16.3 Service under Clause 3 as well as the free call bonus shall be valid as long as the user’s phone number does not fall into a temporary or permanent suspension period;

     16.4 Such free call bonus applies to any call made to mobile or fixed line number used or registered in Thailand only, excluding those made to any special number, international calls, international roaming, SMS and other value-added services. It can be neither transferable nor redeemable for cash nor any other promotions.

17. By joining TrueLife Free View the users are required to comply with Terms and Conditions of such program.

18. By joining hi-speed Internet SUPER Package the users should read Terms and Conditions of such program before signup for service.

19. The users are entitled to use True Transfer after having their TrueMove Pre Pay account activated at least 75 days.

20. This “Super Buffet” promotion is valid until 30 November 2010.

21. “Objectives of the contract”: The User agrees to use the service under this promotion for normal, personal and individual use with honest interest, not for otherwise. The User shall not use, exploit, modify or commit any act on technology or system or any other devices so as to connect or relate to such service and shall not commit or omit any act that can be described or anticipated or believed that it shall cause an immoral act or a damage or an unfair treatment to TrueMove or any other person directly or indirectly or disturbance or inconvenience or hazard to network or make the network or its part malfunction in any way.

If the User commits any act according to the aforesaid paragraph, it shall be deemed that the User offends the objectives of the contract. TrueMove reserves the rights to immediately terminate its service under this contract if there is a reasonable ground to believe that the User uses the services by any of the following ways:
     1 Use the services against the contract or the prohibition of the contract or offend the objectives of the contract or has a dishonest intention towards the service or commit any act that causes or can be anticipated or believed that it shall cause damage to TrueMove in any way; or
     2 Use the service by way of defraud; or
     3 Use the service illegally.

22. Any right/privilege/eligibility under this promotion cannot be changed, exchanged, refunded for cash or any other items or transferred to any other individual or corporate persons.

23. TrueMove reserves the rights to suspend, change or cancel this Terms and Conditions if this service is exploited for commercial advantage or there is any illegal act or failure to comply with specified Terms and Conditions or if TrueMove wishes to amend or change this Terms and Conditions without prior notice. TrueMove reserves the rights to change, amend or terminate service rates as well as any Terms and Conditions with advance notice through any appropriate communication channels.

24. TrueMove reserves the rights to amend, change, suspend or terminate this service without prior notice if there is any regulation, order or policy of any relevant authority causing TrueMove to change, suspend or terminate this Terms and Conditions or such order increases burden to TrueMove operation.

25. This promotion is subject to terms and conditions set forth by TrueMove. Users shall find out more information prior to using this service with True Move Care on 1331 or by enquiring any TrueMove sales representative. TrueMove reserves the rights to discontinue its service, alter any type of service, amend any condition or call rate as it deems appropriate with notice subject to change.

Entitlement Policy
1. If the users wish to exercise the right for making unlimited calls within TrueMove network during the buffet period after end of the 30-day promotional period, the users should call 9331 (toll free) to sign up for the “Super Buffet” promotion again subject to the aforesaid Terms and Conditions, within the specified period under this promotion.

2. The users may apply for the “Super Buffet” promotion to take the right to make unlimited calls within TrueMove network during buffet period in advance by not exceeding one billing cycle (one billing cycle is 30 days).
