Terms and Conditions of “TrueMove 299: Free TrueMove Call 24 hours (Bonus 50 Baht for 6 months)” promotion

1 This promotion is applicable to both individual and corporate TrueMove Post Pay subscribers from 8 July - 8 September 2010 or until further notice.

2 The followings are service fees for this promotion:
     2.1 Service fee as from the date of start using this promotion covers minimum monthly fee of 299 Baht. Accordingly, fees for outgoing calls covered by monthly fee and the excess thereof can be described as follows:
          2.1.1 Unlimited calls within TrueMove network;
          2.1.2 Calls made outside TrueMove network throughout 24 hours are charged in addition to the aforesaid monthly fee at 2 Baht for the first minute and 1 Baht per minute afterwards based on per minute billing and a fraction of each minute is counted as one minute;
          2.1.3 GPRS fee is charged at 1 Baht per minute in addition to the minimum monthly fee based on per minute billing and the fraction of each minute is counted as one minute. Such fee excludes 7% value added tax;
     2.2 The users are required to pay the aforesaid minimum monthly fee as per Clause 2.1 as well as the excess thereof as per Clause 2.1.2, GPRS fee as per Clause 2.1.3 and fees for any other value added services at the normal rate based on actual use (if any);
     2.3 The users are eligible to receive an extra calling bonus worth 50 Baht per month for six months as from the date of activation for calls made to TrueMove numbers throughout 24 hours. Accordingly, fee will be deducted from the said calling bonus first and then charged additionally for the excess. The calling bonus cannot be rolled over to the next month.

3. All aforesaid service fees as per Clause 2 are applied for any calls made to mobile or fixed line numbers used or registered in Thailand as well as specified value added services but exclude calls made to any special numbers other than fixed line numbers, SMS, data transfer, information service, international calls, international roaming and any other additional services.

4. The users under this promotion may apply for the following Welcome Services free of charge:
     4.1 Phonebook transfer from existing SIM card into TrueMove SIM card.
     4.2 SMS alert of new TrueMove number to all TrueMove contacts in the existing SIM, for whom registered for service in Thailand. The maximum numbers to be sent shall not exceed 250.
     4.3 Those whose SIM have been lost or damaged are eligible to one free service on change of SIM with existing TrueMove number.
     4.4 SMS alert when the credit line reaches the specified monthly fee (an application is required).

5. The aforesaid rates exclude value added tax.

6. The aforesaid calling bonus cannot be exchanged, refunded or changed for cash or transferred to any other persons.

7. This promotion cannot be used in conjunction with All Together Bonus but can be used with TrueLife Free View and upspeed SUPER hi-speed Internet programs.

8. Objectives of the contract”: The User agrees to use the service under this promotion for normal, personal and individual use with honest interest, not for otherwise. The User shall not use, exploit, modify or commit any act on technology or system or any other devices so as to connect or relate to such service and shall not commit or omit any act that can be described or anticipated or believed that it shall cause an immoral act or a damage or an unfair treatment to TrueMove or any other person directly or indirectly or disturbance or inconvenience or hazard to network or make the network or its part malfunction in any way.

If the User commits any act according to the aforesaid paragraph, it shall be deemed that the User offends the objectives of the contract. TrueMove reserves the rights to immediately terminate its service under this contract if there is a reasonable ground to believe that the User uses the services by any of the following ways:
     (1) Use the services against the contract or the prohibition of the contract or offend the objectives of the contract or has a dishonest intention towards the service or commit any act that causes or can be anticipated or believed that it shall cause damage to TrueMove in any way; or
     (2) Use the service by way of defraud; or
     (3) Use the service illegally.

9. This promotion is valid for a period of six months as from the date of activation.

10. Should there be any regulation, order or policy set out by any relevant public authority to change, suspend or cancel any term and condition of this promotion, TrueMove reserves the rights to change such term and condition without prior notice.

11. TrueMove reserves the rights to suspend, change or cancel service fees as well as any Terms and Conditions as appropriate with not less than 30-day advance notice through any available channels.

12. TrueMove reserves the rights to suspend or discontinue this promotion if it considers that there is any dishonest behavior or fraud of document so as to take advantage of this promotion or abuse of mobile phone service or any illegal act or failure to comply with terms and conditions of this promotion.

13. TrueMove reserves the rights to allocate selectable phone numbers only for the number groups it deems appropriate.
