Terms and Conditions of “TrueMove 199 iSport” promotion
1. This promotion is reserved for those who apply for TrueMove Post Pay service as individual person during the period from 18 May to 31 July 2010 or until further notice.
2. Minimum monthly fee for this promotion as from the date of activation is 199 Baht. Fees in relation to monthly allowance and the excess thereof cover the following details:
2.1. Call made to any TrueMove numbers between 07:00 am and 6:59 pm is not charged and call made during any other time i.e. 7:00 pm – 6:59 am will be charged in addition to the aforesaid monthly fee at 0.75 Baht per minute based on per minute billing with a fraction of each minute counted as one minute;
2.2. Call made outside TrueMove network throughout 24 hours is charged in addition to the aforesaid monthly fee at 1.50 Baht per minute based on per minute billing with a fraction of each minute counted as one minute;
2.3. SMS fee is charged in addition to the aforesaid monthly fee at 1.50 Baht per message;
Remark: Short message (SMS) is limited to 70 Thai characters and 160 English characters including spaces.
2.4 MMS fee is charged in addition to the aforesaid monthly fee at 1.50 Baht per message;
2.5 GPRS/EDGE/Wi-Fi fee is charged in addition to the aforesaid monthly fee at 1 Baht per minute based on per minute billing with a fraction of each minute counted as one minute;
2.6 Privilege:
2.6.1 The users will receive 2010 World Cup or Premier League news updates and first-and-second-half match results totaling 2-6 articles per message per day by SMS with no additional charge;
2.6.2 The users will receive other sport updates of 2 articles per message per day with no additional charge. In case of terminating news updates, the users are required to text SC to 9191. Upon reapplication for the service, the users will have to pay for the SMS service of first-and-second-half match results at 30 baht per month;
2.6.3 The users will be eligible to listen to football match results and analysis or play quiz for 10 minutes per month via *8812 with no additional charge. However, fee will be charged at 5 Baht per minute from the 11th minute onwards.
3. The users are required to pay for minimum monthly fee and the excess thereof (if any) as specified under Clause 2 as well as other value added service fees at the normal rate based on actual use (if any).
4. GPRS and EDGE are a SIM card based service. The users can get access to the Internet from a GPRS and EDGE enabled mobile phone, modem-based notebook or other GPRS/EDGE enabled devices (such as GPRS PCMCIA wireless aircard or infrared/Bluetooth enabled mobile phone.)
5. The quality of GPRS or EDGE service offered by TrueMove or Wi-Fi service offered by True Internet Co., Ltd. (True Internet) in both unlimited and limited time of use may be slower or not available to access if the users make an access from an inappropriate area.
6. Minimum monthly fee excludes any service charges other than those specified under Clause 2 such as True Move Assistant, True World, content downloads, SMS/MMS service (except for those specified under Clauses 2.3 and 2.4), data/information service, international call, international roaming and any other value added services.
7. To connect to GPRS and EDGE by TrueMove and Internet by True Internet, the users first need to set up and activate the services. Please refer to the user’s manual or contact the router manufacturer.
8. TrueMove and True Internet shall exercise due caution for safety and security of GPRS, EDGE and Wi-Fi by TrueMove and Internet network by True Internet. However, the users shall be aware of or take a personal security measure so as to prevent his/her computer or notebook or any other wireless equipment from a hacker or virus. (It is recommended that firewall and anti-virus programs should be installed.)
9. TrueMove and True Internet reserve the rights not to be responsible for any loss or damage or loss of data occurred from delay or disruption of data service or access failure, hazardous data or content download. In this matter, the users shall take sole responsibility for such act and ensure that such downloaded content or data comes from a reliable source.
10. All aforesaid service fees are exclusive of value added tax.
11. This promotion is valid for a period of six months as from the date of activation.
12. This promotion cannot be used in conjunction with All Together Bonus
13. “Objectives of the contract”: The user agrees to use the service under this promotion for normal, personal and individual use with honest interest, not for otherwise. The user shall not use, exploit, modify or commit any act on technology or system or any other devices so as to connect or relate to such service and shall not commit or omit any act that can be described or anticipated or believed that it shall cause an immoral act or a damage or an unfair treatment to TrueMove or any other person directly or indirectly or disturbance or inconvenience or hazard to network or make the network or its part malfunction in any way.
If the user commits any act according to the aforesaid paragraph, it shall be deemed that the user offends the objectives of the contract. TrueMove reserves the rights to immediately terminate its service under this contract if there is a reasonable ground to believe that the User uses the services by any of the following ways:
1. Use the services against the contract or the prohibition of the contract or offend the objectives of the contract or has a dishonest intention towards the service or commit any act that causes or can be anticipated or believed that it shall cause damage to TrueMove in any way; or
2. Use the service by way of defraud; or
3. Use the service illegally.
14. TrueMove reserves the rights to terminate this promotion if there is an announcement or a change of service rate as a result of order and/or policy of relevant public authority and TrueMove reserves the rights to change such service rate without prior notice.
15. TrueMove reserves the right to amend, change or cancel the service rate as well as any terms and conditions as appropriate with advance notice not less than 30 days through any appropriate channels.
16. TrueMove reserves the rights to suspend or discontinue its services under this promotion if it considers that there is any dishonest behavior or fraud of document so as to take advantage of this promotion or abuse of mobile phone service or any illegal act or failure to comply with terms and conditions of this promotion without prior notice.
