Terms and Conditions of “Pro Smart Pack”, “hi-speed Mobile Internet SIM” and “Pro iPack” promotions

1. This “Pro Smart Pack” “Hi-Speed Mobile Internet SIM” and “Pro iPack” promotions are applicable to individual TrueMove Post Pay subscribers.

2. The followings are conditions and service rates for each single promotion:
     2.1    Pro Smart Pack
          2.1.1 Signup period runs from 17 March to 3 June 2010 or until further notice and this promotion is valid for a period of 6 months (billing cycles) from the date of activation;
          2.1.2 Minimum monthly fee of 449 Baht covers the following services: 
              2.1.2.1 Allowance for calls made to TrueMove numbers of 200 minutes per month and from the 201st minute onwards, fee will be charged for calls made to any networks throughout 24 hours in addition to the minimum monthly fee at 1.50 Baht per minute based on per minute billing with a fraction of each minute counted as one minute;
              2.1.2.2 Allowance for sending 30 short messages (SMS) per month and the excess thereof will be charged in addition to the minimum monthly fee at the normal rate (3 Baht per SMS);
              2.1.2.3 Allowance for EDGE/GPRS service of 200 MB per month (billing cycle) and the excess thereof will be charged in addition to the minimum monthly fee at 10 Baht per megabyte with a fraction of each megabyte counted as one megabyte;
              2.1.2.4 Allowance for 1 Mbps Wi-Fi service of 5 hours per month (billing cycle) and the excess thereof will be charged in addition to the minimum monthly fee at 1 Baht per minute based on per minute billing with a fraction of each minute counted as one minute;
             2.1.2.5 Allowance for 3G* trial service of 500 MB per month (billing cycle) until 30 April 2010. The remaining time cannot be rolled over or changed, refunded or exchanged for cash or any other items or transferred to any other individual or corporate person;

Remark: 33G service is part of TrueMove network improvement scheme in certain areas. TrueMove reserves the right to amend, change, suspend or discontinue the service at any time as appropriate with notice through any appropriate communication channels.

         2.1.3 All service rates under Clause 2.1.2 cover only calls made to mobile or fixed-line numbers used or registered locally, SMS and Wi-Fi/EDGE/GPRS as specified only which exclude fees for other services such as TrueMove Assistant, TrueLife, content downloads, MMS, information service, international call, international roaming and other value added service;
         2.1.4 Fee for sending MMS among mobile phone used or registered locally is charged in addition to the minimum monthly fee at 5 Baht per MMS (if any);
         2.1.5 During the period of using this promotion, the users are eligible to sign up for additional Wi-Fi/EDGE/GPRS package based on daily service only;
         2.1.6 Existing TrueMove Post Pay subscribers may switch to this promotion.

     2.2 “Hi-Speed Mobile Internet SIM”
         2.2.1 Signup period runs from 17 March to 5 May 2010 or until further notice and this promotion is valid for a period of 4 months (billing cycles) from the date of activation;
         2.2.2 Minimum monthly fee of 349 Baht covers the following services:
               2.2.2.1 Allowance for EDGE/GPRS and/or Wi-Fi (1 Mbps) service worth together 120 hours per month (billing cycle) and the excess thereof will be charged additionally as follows;
               (1) EDGE/GPRS fee is charged at 1 Baht per minute based on per minute billing with a fraction of each minute counted as one minute;
               (2) Wi-Fi (1 Mbps) fee is charged at 1 Baht per minute based on per minute billing with a fraction of each minute counted as one minute.
               2.2.2.2 Allowance for 3G* trial service of 5 hours per month (billing cycle) until 30 April 2010. The remaining time cannot be rolled over or changed, refunded or exchanged for cash or any other items or transferred to any other individual or corporate person;

Remark: 3G service is available on a trial phase only in permitted areas. TrueMove reserves the right to amend, change, suspend or discontinue the service at any time as appropriate with notice through any appropriate communication channels.
          2.2.3 All service rates under Clause 2.2.2 cover Wi-Fi/EDGE/GPRS as specified only which exclude fees for calls made to mobile or fixed-line numbers used or registered locally or other services such as TrueMove Assistant, TrueLife, content downloads, MMS, information service, international call, international roaming and other value added service;
          2.2.4 Fees for TrueMove service, SMS, MMS are charged in addition to the minimum monthly fee as per Clause 2.2.2 as follows;
               2.2.4.1 Calls made to any networks are charged at 1.50 Baht per minute throughout 24 hours based on per minute billing with a fraction of each minute counted as one minute;
               2.2.4.2 Fee for sending SMS is charged at 3 Baht per SMS and fee for sending MMS among mobile phones used and registered locally is charged at 5 Baht per MMS;
          2.2.5 During the period of using this promotion, the users are eligible to sign up for additional Wi-Fi/EDGE/GPRS package based on daily service only;
          2.2.6 Existing TrueMove Post Pay subscribers may switch to this promotion.

     2.3 “Pro iPack”
          2.3.1 Applicants of this promotion are required to show a specified model of iPhone 3G or iPhone 3GS with its imei number and Wi-Fi address to activate the iPack 699 package subject to TrueMove sole consideration;
          2.3.2 Signup period runs from 11 March to 31 August  2010 or until further notice and this promotion is valid for a period of 12 months (billing cycles) from the date of activation;
          2.3.3 Minimum monthly fee of 699 Baht covers the following services:
               2.3.3.1 Allowance for outgoing calls of 300 minutes per month and the excess thereof is charged in addition to the minimum monthly fee at 1.50 Baht per minute for calls made to any networks throughout 24 hours based on per minute billing with a fraction of each minute counted as one minute;
               2.3.3.2 Allowance for sending 300 SMS  per month and the excess thereof will be charged in addition to the minimum monthly fee at 1.50 Baht per SMS throughout 24 hours;
               2.3.3.3 Allowance for sending 90 MMS  per month and the excess thereof will be charged in addition to the minimum monthly fee at 2.50 Baht per SMS throughout 24 hours;
               2.3.3.4 Unlimited EDGE/ GPRS access;
               2.3.3.5 TrueMove 3G* trial service of 1 GB per month and the service will be immediately cut out upon end of the allowance and the users are able to reconnect on the subsequent month/billing cycle but the remaining amount cannot be rolled over to the following month/billing cycle; 
                2.3.3.6 Unlimited Wi-Fi access and the users are required to view Terms and Conditions of Wi-Fi by TrueMove Unlimited Package on www.truewifi.net or 02-900-9000 press 89;
          2.3.4 The users are required to pay the minimum monthly fee and the excess thereof as well as fees for value added services and any services other than those specified under Clause 2.3.3 at the normal rate (if any);
          2.3.5 All service rates under Clause 2.3.3 cover only calls made to mobile or fixed-line numbers used or registered locally as well as value added services as per Clause 2.3.3 which exclude fees for calls made to special numbers, any services other than those specified under Clause 3, data transfer, information service, international calls, international roaming;

Remark: *3G service is available on a trial phase only in permitted areas. TrueMove reserves the right to offer the service of not exceeding 1 GB per month and reserves the right to amend, change, suspend or discontinue the service at any time as appropriate with notice through any appropriate communication channels.
          2.3.6 This promotion cannot be used in conjunction with TrueLife Free View and TrueVisions SIM promotions;
          2.3.7 Terms and Conditions of TrueMove services are available on www.truemove.com or 08-2000-3333.

3 All the aforesaid fees are subject to value added tax.

4 Terms and Conditions of Wi-Fi/EDGE/GPRS service
     4.1 The Wi-Fi/EDGE/GPRS users of any aforesaid promotions acknowledge and accept Terms and Conditions set forth by TrueMove and True Internet for each promotion; 
     4.2 EDGE and GPRS are a SIM card based service for an access of wireless Internet via GPRS and EDGE enabled mobile phone;
     4.3 A system setup and installation is needed before connecting to EDGE and GPRS offered by TrueMove and Internet service offered by True Internet. The users shall find out more information on system setup and installation from the manufacturer or the user’s manual;
     4.4 TrueMove and True Internet shall exercise due caution for the security of Wi-Fi/EDGE/GPRS service offered by TrueMove and Internet service offered by True Internet. However, the users shall also foster awareness for their own personal computer, notebook or other wireless devices to prevent it from hacking or software viruses. (It is recommended that the User installs a firewall or anti-virus program);
     4.5 True Move and True Internet reserve the rights not to be liable for any loss or damage of data/information caused by delay or disruption of service or access failure, download of hazardous contents, provided that the User shall solely take responsibility of the same and ensure that such downloaded content or information comes from a reliable source;
     4.6 The Wi-Fi by TrueMove users are able to use their mobile phone number as username followed by @truemove domain name (for example: 08xxxxxxxx@truemove) and password will be delivered by SMS;
     4.7 Wi-Fi by TrueMove username and password will be delivered within 6 hours from activation;
     4.8 In case of forgetting password, the users may request for a new Password on 1331 or *9000 press 4;
     4.9 During the service period, Wi-Fi by TrueMove will be disconnected every 90 minute (session time out) for monitoring and tracking usage. If wishing to continue going online, the users are required to switch off and switch on the receiver again;
     4.10 In case of forgetting to log out or being inactive for 10 minutes, the system will be automatically logged out;
     4.11 A Wi-Fi by TrueMove account allows one concurrent user only.

5. In case of switching promotion, it shall be deemed that any right/eligibility/privilege under the existing promotion is immediately terminated. Additionally, any right/eligibility/privilege under the existing promotion cannot be changed, refunded, exchanged for cash or any other items or transferred to any other individual or corporate persons.

6. “Objectives of the contract”: The user agrees to use the service under this promotion for normal, personal and individual use with honest interest, not for otherwise. The user shall not use, exploit, modify or commit any act on technology or system or any other devices so as to connect or relate to such service and shall not commit or omit any act that can be described or anticipated or believed that it shall cause an immoral act or a damage or an unfair treatment to TrueMove or any other person directly or indirectly or disturbance or inconvenience or hazard to network or make the network or its part malfunction in any way.

If the user commits any act according to the aforesaid paragraph, it shall be deemed that the user offends the objectives of the contract. TrueMove reserves the rights to immediately terminate its service under this contract if there is a reasonable ground to believe that the User uses the services by any of the following ways:

6.1 Use the services against the contract or the prohibition of the contract or offend the objectives of the contract or has a dishonest intention towards the service or commit any act that causes or can be anticipated or believed that it shall cause damage to TrueMove in any way; or
6.2 Use the service by way of defraud; or
6.3 Use the service illegally.

7. TrueMove reserves the right to suspend, change or discontinue the aforesaid Terms and Conditions if there is any illegal act or failure to comply with the specified Terms and Conditions without prior notice.

8. Unless expressly stated, TrueMove reserves the right to amend, change or discontinue the aforesaid Terms and Conditions with at least 30-day advance notice through any available communication channels as appropriate.

9. TrueMove reserves the right to suspend or discontinue services under this promotion if there is any regulation, order or policy stated otherwise by any relevant public authority causing TrueMove to amend, suspend or cancel any Terms and Conditions of this promotion so as to comply with such regulation, order or policy or if TrueMove considers that there is any dishonest or fraud of document so as to take advantage of this promotion or abuse of mobile phone service, or any illegal act or failure to comply with Terms and Conditions of this promotion without prior notice.
