Terms and Conditions of “TrueMove 199: Call a buddy at 25 Satang per minute” promotion

1. This promotion is available for individual TrueMove Post Pay subscribers from 3 February to 31 March 2010 or until further notice.

2. Minimum monthly fee of 199 Baht cover the following details:
     2.1 Minimum service fee of 199 Baht per month covers outgoing calls worth 199 Baht per month and fees for outgoing calls covered by monthly fee and the excess thereof can be described as follows:
         2.1.1 Calls made to the buddy number (must be a TrueMove number used and registered in Thailand and nominated as the matching number) throughout 24 hours which are charged at 0.25 Baht (25 Satang) per minute;
         2.1.2 Calls made to other TrueMove numbers or other networks throughout 24 hours are charged at 1.50 Baht per minute based on per minute billing and a fraction of each minute is counted as one minute;
     2.2 GPRS fee is charged in addition to the minimum monthly fee at 1 Baht per minute based on per minute billing and a fraction of each minute is counted as one minute. Such fee is exclusive of 7% VAT.
     2.3 The users are entitled to send 30 short messages (SMS) to mobile phones used and registered in Thailand for a period of 3 months as from the date of signup for this promotion. Accordingly, rollover is not acceptable.
     2.4 The users are required to pay a minimum monthly fee as per Clause 2.1 as well as the excess thereof and other value added service fees as per actual use (if any).
     2.5 The users are entitled to call the buddy number as per Clause 2.1.1 after having the number registered/nominated and can check the registered number on 1331 or by contacting any True Shops or TrueMove Shops. Accordingly, TrueMove has registered the matching number as per the numbers provided in the “Matching SIM” (or Koo Gun SIM) pack for free at the first time but if the users wish to change the nominated number, a service fee of 50 Baht per change will be charged.  

3 All aforesaid service fees as per Clause 2 are applied for any calls made to mobile or fixed line numbers used or registered in Thailand as well as specified value added services but exclude calls made to any special numbers other than fixed line numbers, SMS, data transfer, information service, international calls, international roaming and any other additional services.

4 The users under this promotion may apply for the following Welcome Services free of charge:
     4.1 Phonebook transfer from existing SIM card into TrueMove SIM card.
     4.2 SMS alert of new TrueMove number to all TrueMove contacts in the existing SIM, for whom registered for service in Thailand. The maximum numbers to be sent shall not exceed 250.
     4.3 Those whose SIM have been lost or damaged are eligible to once free service on change of SIM with existing TrueMove number.
     4.4 SMS alert when the credit line reaches the specified monthly fee (an application is required).

5 All rates are exclusive of VAT.

6 This promotion cannot be used in conjunction with All Together Bonus, but can with TrueLife Free View and upspeed SUPER hi-speed Internet programs.

7 “Objectives of the contract”: The User agrees to use the service under this promotion for normal, personal and individual use with honest interest, not for otherwise. The User shall not use, exploit, modify or commit any act on technology or system or any other devices so as to connect or relate to such service and shall not commit or omit any act that can be described or anticipated or believed that it shall cause an immoral act or a damage or an unfair treatment to TrueMove or any other person directly or indirectly or disturbance or inconvenience or hazard to network or make the network or its part malfunction in any way. If the User commits any act according to the aforesaid paragraph, it shall be deemed that the User offends the objectives of the contract. TrueMove reserves the rights to immediately terminate its service under this contract if there is a reasonable ground to believe that the User uses the services by any of the following ways:
     1. Use the services against the contract or the prohibition of the contract or offend the objectives of the contract or has a dishonest intention towards the service or commit any act that causes or can be anticipated or believed that it shall cause damage to TrueMove in any way; or
     2. Use the service by way of defraud; or
     3. Use the service illegally

8 Should there be any regulation, order or policy set out by any relevant public authority causing TrueMove to change, suspend or cancel any Terms and Conditions of this promotion, TrueMove reserves the rights to change or amend such Terms and Conditions without prior notice. In this matter, such act shall not jeopardize the rights of TrueMove to change or amend Terms and Conditions of this promotion as deemed appropriate without prior notice.

9 TrueMove reserves the rights to suspend, change or cancel service fees as well as any Terms and Conditions as appropriate with a 30-day advance notice through any appropriate channels.

10 TrueMove reserves the rights to suspend or discontinue the services under this promotion if it considers that there is any dishonest behavior or fraud of document so as to take advantage of this promotion or abuse of mobile phone service or any illegal act or failure to comply with terms and conditions of this promotion.

11 This promotion lasts six months as from the date of signup.
