Terms and Conditions of TrueMove 299 4in1 Wi-Fi/EDGE/GPRS

1.   This promotion is applicable to individual TrueMove Post Pay subscribers from 16 January to 3 March 2010 or until further notice.

2.   Minimum monthly fee of 299 Baht covers outgoing calls worth 299 Baht according to the following details:
     2.1.    Fee for calls made to any networks any time throughout 24 hours is charged at the rate of 1.25 Baht per minute based on actual use as per minute billing and a fraction of each minute is counted as one minute;
     2.2.    Fee for sending SMS and MMS is charged at 1.25 Baht per message;
     2.3.   Either GPRS/EDGE and/or Wi-Fi service(s) is/are allowed inclusively for 30 hours per month (from the first to the sixth billing cycles). Rollover is not acceptable.

3.    In case of excess use of minimum monthly fee as per Clauses 2.1 and 2.2 or of services as per Clause 2.3, charge will be applied as per the following details:
     3.1   Fee for calls made to any networks throughout 24 hours is charged at the rate of 1.25 Baht per minute base on per minute billing and a fraction of each minute is counted as one minute;
     3.2   Fee for sending SMS and MMS is charged at 1.25 Baht per message;
     3.3  GPRS and EDGE access is charged additionally based on actual use at the rate of 1 Baht  per minute based on per minute billing and a fraction of each minute is counted as one minute;
     3.4 Wi-Fi service is charged at the rate of 1 Baht per minute.

4. The users are required to pay monthly fee as per Clause 2, excess fee as per Clause 3 and other value added service fees at the normal rate based on actual use (if any).  

5.    GPRS and EDGE are a SIM card based service. The users can get access to Internet from a GPRS and EDGE enabled mobile phone, modem-based notebook or other GPRS/EDGE enabled devices (such as GPRS PCMCIA wireless aircard or infrared/Bluetooth enabled mobile phone.)

6.   The quality of GPRS or EDGE service offered by TrueMove or Wi-Fi service offered by True Internet Co., Ltd. (True Internet) in both unlimited and limited time of use may be slower or not available to access if the users make an access from an appropriate area.

7.   Minimum monthly fee excludes any service charges other than those specified under Clause 2 such as True Move Assistant, True World, content downloads, data/information service, international call, international roaming and any other value added services.

8.   To connect to GPRS and EDGE by TrueMove and Internet by True Internet, the users first need to set up and activate the services. Please refer to the user’s manual or contact the router manufacturer.

9.    TrueMove and True Internet shall exercise due caution for safety and security of GPRS, EDGE and Wi-Fi by TrueMove and Internet network by True Internet. However, the users shall be aware of or take a personal security measure so as to prevent his/her computer or notebook or any other wireless equipment from a hacker or virus. (It is recommended that firewall and anti-virus programs should be installed.)

10.    TrueMove and True Internet reserve the rights not to be responsible for any loss or damage or loss of data occurred from delay or disruption of data service or access failure, hazardous data or content download. In this matter, the users shall take sole responsibility for such act and ensure that such downloaded content or data comes from a reliable source.

11.    All aforesaid service fees are exclusive of value added tax.

12.    This promotion is valid for a period of six months as from the date of activation.

13.    This promotion cannot be used in conjunction with All Together Bonus but can be used with TrueLife Free View and upspeed SUPER hi-speed Internet programs.

14.    “Objectives of the contract”: The User agrees to use the service under this promotion for normal, personal and individual use with honest interest, not for otherwise. The User shall not use, exploit, modify or commit any act on technology or system or any other devices so as to connect or relate to such service and shall not commit or omit any act that can be described or anticipated or believed that it shall cause an immoral act or a damage or an unfair treatment to TrueMove or any other person directly or indirectly or disturbance or inconvenience or hazard to network or make the network or its part malfunction in any way.

If the User commits any act according to the aforesaid paragraph, it shall be deemed that the User offends the objectives of the contract. TrueMove reserves the rights to immediately terminate its service under this contract if there is a reasonable ground to believe that the User uses the services by any of the following ways:
     1. Use the services against the contract or the prohibition of the contract or offend the objectives of the contract or has a dishonest intention towards the service or commit any act that causes or can be anticipated or believed that it shall cause damage to TrueMove in any way; or
     2. Use the service by way of defraud; or
     3. Use the service illegally.

15.    TrueMove reserves the rights to terminate this promotion if there is an announcement or a change of service rate as a result of order and/or policy of relevant public authority without prior notice.

16.    TrueMove reserves the right to amend, change or cancel the service rate as well as any terms and conditions as appropriate with notice not less than 30 days in advance through any available channels.

17.    TrueMove reserves its rights to suspend or discontinue its services under this promotion if it considers that there is any dishonest behavior or fraud of document so as to take advantage of this promotion or abuse of mobile phone service or any illegal act or failure to comply with terms and conditions of this promotion.
